We do not collect information, maintain a data base, or in any way use, sell, transfer, or convey any information or data about any person, business, or organization who has been in contact with us for any reason.

Terms and Conditions

  1. All sales are final. All payments must be made by check or bank transfer. We do not accept PayPal, credit cards, or any other form of payment that requires us to pay a fee or service charge.
  2. Representations and warranties. a) We represent and warrant that we convey good and valid title to the paintings and other works of art we sell and that they are free and clear of all encumbrances of any kind; and (b) We have the right to sell the paintings and other work of art.
  3. Disclaimer of warranties. Except for the warranties set forth in paragraph 2 above, we make no representation or warranties whatsoever of authenticity, genuineness, provenance, authorship, attribution, value, or quality of the paintings and other works of art we sell or the stamps, certificates or documents that may accompany them. Buyers agree that they have not relied on any representation or warranty except those specified in paragraph 2.
  4. Each Buyer acknowledges. a) He has had adequate access to and made a thorough investigation and inspection of the art item(s) that are purchased: (b) He has evaluated the quality, condition, provenance, value, and authenticity of the items he has purchased and has  relied solely upon his own inspection and investigation and the representations and warranties of Seller set forth in Section 2 above and (ii) accepts title to each item “as-is,” with all faults and in the condition existing as of the date of this sale. Buyers expressly assume the risk of and waive all claims they may have with respect to the quality, condition, value, provenance, authenticity, and suitability of the item(s).
  5. Limitation of liability. In no event shall we be liable in connection with the sale of an item(s) to a buyer or any third party for consequential, indirect, incidental, special, exemplary, punitive or enhanced damages, lost profits or revenues, or diminution in value arising from, related to, or in connection with any breach of the terms and conditions of a saIe, regardless of (1) whether such damages were foreseeable, (2) whether or not the Buyer was advised of the possibility of such damages, and (3) the legal or equitable theory, contract, tort, or otherwise. Upon which a claim is based.
  6. Maximum Liability. In no event shall our aggregate liability, whether arising out of or related to breach of contract, including negligence or otherwise, exceed the total of the amounts paid to us.
  7. The rights and obligations of Buyers and Seller are governed by and construed in accordance with the laws of the State of Arizona. Without regard to Buyer’s location, Buyer and Seller agree that any claims or disputes involving them that arise out of or are related to a transaction shall be resolved exclusively by a state or federal court located in Maricopa County. Arizona, whether or not any such claim or dispute invoIves third parties. Buyers waive any objection as to inconvenient forum and right to a jury trial. Buyers agree that regardless of any law to the contrary, each claim or cause of action a Buyer may have against us must be filed within the applicable statute of limitations, or, if earlier, one year after such claim or cause of action arose, or else such claim or cause of action will be permanently barred. Nothing will prevent us from seeking injunctive or other equitable relief in any jurisdiction.
